Flushed, LLC | Payment Terms & Event Details Deposit: Required with each trailer rental in the amount of $750. This is due upon the quote being electronically accepted.
Final Payment: is due 21 days prior to the event. *If payment is not received Flushed, LLC reserves all rights to cancel the rental and keep the deposit.
Customers Responsibility on Arrival: Provide the appropriate electrical power & access to running water attached to a garden hose near the location of the trailers unless previously discussed otherwise.

TERMS AND CONDITIONS
This Order contains a Restroom Trailer: It is the Customer's responsibility to provide the appropriate electrical power (unless discussed otherwise). Power requirements are stated in the item description in this Contract. The portable restroom must be located on a level area not more than 100 ft from the main power source. This power must be left on continuously during winter months when outside temperature may reach freezing. Damages incurred from frozen water lines and fixtures will be the customer's responsibility.
It is the Customer's responsibility to have running water attached to a garden hose to the location of the portable restroom. This water is used for hand wash sinks and flushing. If temperatures are freezing, or below, the internal fresh water tank must be used rather than a hose.
The Portable Restroom Trailer must be clear and accessible for the service truck at all times.
The Portable Restroom Trailer cannot be moved or removed from the delivered site without specific written permission from Flushed, LLC.
The Customer agrees to pay for any damages to or loss of the portable restrooms as an insurer, regardless of cause or fault except for reasonable wear and tear, while the portable restrooms are at the delivered site.
The Portable Restroom Trailer is delivered free of visible damage and or graffiti. The Customer will be responsible and charged for any damages or replacement costs incurred from repairing such damage.
For rentals longer than 1 week, the waste tank must be pumped weekly at a fee of $650.00.
Cleaning will include replacing necessary paper products.
Emergency visits are billed at $85.00 per hour plus mileage, minimum of $200.
Cancellation: Once reserved, all items are withheld from inventory for your event. The deposit of each item is nonrefundable for all cancellations. All monies are forfeited if cancellation is requested with less than 14 days before the event.
Permits and Licenses: The renter shall obtain and assume the cost of any permits or licenses if required by local or county ordinances. If the event is shut down due to lack of proper permits, Flushed, LLC will not be held liable for any loss.
Grant Access: Customer agrees to grant Flushed, LLC access to drive on property to location of rental items for delivery and removal.
Identification: Customer agrees that Flushed, LLC’s identifying marks, including logos, trademarks, service marks, and trade names may appear on the rented equipment and goods while in use by Customer.
Inspection: Customer agrees to inspect all items and verify quantity and condition before accepting possession. All items accepted shall be considered to be in satisfactory condition.
Customer agrees if Customer or Customers appointed representative or agent cannot be available to verify quantities at the time of delivery, the count of Flushed, LLC. is considered accurate, acceptable and binding.
Warranties: Flushed, Inc. makes no warranties either expressed or implied. There is no warranty that any rental or sale item is suited for Customer’s intended use.
Use and Care of Items: Customer agrees that before use, the proper operation and use of any item will be understood by Customer or Customer’s appointed representative or agent Customer agrees that before use, the proper operation and use of any item will be understood by Customer or Customer’s appointed representative or agent loss by theft, vandalism or malicious mischief at all times until possession is regained by Flushed, LLC.
Acceptance of Risk: All equipment is used at the risk of the Customer. Conditions which prevent satisfactory use do not relieve customers from responsibility of rental charges. Customer accepts any item as is and assumes all risks. It is expressly understood and agreed by the Customer that Flushed, LLC shall not be liable in any manner and shall be held harmless for any injuries or damages caused to person, property, material, or articles whatsoever while in, under, near or about, or during use of any property rented from Flushed, LLC. Flushed, LLC shall not be liable and shall be held harmless for injuries or damages caused by, but not limited to fire, rain, hail, sleet, snow, storms, high winds, tornadoes, floods or other disturbances of nature or other equipment falling by reason thereof to any person, material or articles while in, under, near or about, or during use of any property rented from Flushed, LLC.
Sub Contract: Flushed, LLC may, at its sole option and without reducing its liability hereunder, subcontract all or part of its obligation under this agreement.
Insurance: Certificate of Insurance is available upon request free of charge. If additionally insured is desired, a charge of $165.00 per additionally insured will be due and payable with this signed contract.
Alteration to Equipment: Any item returned in an altered state, including but not limited to tape, graffiti, candle soot, paint, ropes etc., will be charged an additional cleaning fee.
Disputes: All disputes shall be at District Court Towson, MD
